Truck claims can involve a motor carrier, commercial-driver qualification, hours-of-service records, ELD data, vehicle inspection/maintenance records, cargo, federal safety rules, and additional business or insurance relationships that are not usually present in an ordinary passenger-car claim.
As early as practical. FMCSA states that motor carriers must retain records of duty status and supporting documents for six months under 49 CFR 395.8(k)(1). Other records can have different retention practices, so a preservation request should identify the specific evidence needed for the case.
Depending on the facts, the motor carrier, owner/lessor, maintenance provider, cargo loader, or another business may matter. Responsibility should be based on actual conduct and relationships, not assumed simply because an entity appears in a shipping chain.
Usually not for purposes of this site structure. Carma’s Truck page is reserved for semitruck, tractor-trailer, freight, and motor-carrier claims where trucking-specific rules and evidence matter. Delivery vans and company vehicles are addressed on the separate Commercial Vehicle Accidents page.
